Terms and Conditions

  1. Open to US residents aged 18 or over only.

  2. Entries may be submitted until midnight EST on September 11, 2022 (the “Closing Date”).

  3. Winners will be notified via email prior to or during Case Management Week, October 9-15, 2022.

  4. One entry per person. Bulk and/or third-party entries will be void.

  5. All entries must be submitted using this Google Form. All mandatory fields must be completed. Essays are to be written on the topic “Case Managers Are…”. All essays msut be formatted in Google Doc or Word Doc. 

  6. Entries must be the original work of the entrant and not previously published anywhere else. 

    1. If there is any type of lawsuit or claim stating that the contestant infringed someone’s intellectual property rights, the contestant will be responsible for covering any costs incurred by the Case Management Institute, LLC to defend the action.

  7. Entrants will retain copyright in their submitted entries, however, by entering, all entrants licence Case Management Institute, LLC and all subsidieries a worldwide royalty-free perpetual licence to edit, publish, and use each entry in any and all media (including print and online) for SEO, marketing, publicity and news purposes. Case Management Institute, LLC is under no obligation to publish any entries. Please note, that any publication of an entry does not mean that the entrant has won a prize.

  8. All valid entries received before the Closing Date will be reviewed by a panel of judges using the rubric on this page. The highest score will be awarded 1st prize, the next highest will receive 2nd prize and the 3rd highest will receive 3rd prize. In the event of a tie, an additional judge will be brought in to score only the winning essays. Winners will be notified by email and must respond within 5 business days with instructions on claiming the prize. Failure to respond will result in the forfeit of the prize. The Judge’s decision is final. No correspondence will be entered into.

  9. Prizes are as follows

    1. 1st Place – $250 Amazon gift card and publication of your essay

    2. 2nd Place – $100 Amazon gift card and publication of your essay

    3. 3rd Place – $50 Amazon gift card and publication of your essay

    4. Honorable Mentions – Publication of your essay

  10. Winners are responsible for any taxes.

  11. The odds of winning will be dependent on the number of submissions received.

  12. Case Management Institute, LLC will not be liable for technical, hardware, or software failures of any kind or lost or unavailable network connections that may limit or prohibit an eligible entrant’s ability to participate in the competition. Case Management Institute, LLC will not be liable for any loss or damage arising out of the winner’s enjoyment of the prize.

  13. I hereby grant the Case Management Institute, LLC (CMI) the irrevocable right and permission to use photographs of me on CMI and other websites and in publications, promotional flyers, educational materials, derivative works, or for any other similar purpose without compensation to me.  

    1. I understand and agree that such photographs of me may be placed on the Internet. I also understand and agree that I may be identified by name and/or title in printed, Internet or broadcast information that might accompany the photographs of me.  

    2. I hereby release, acquit and forever discharge the Case Management Institute, LLC (CMI), its current and former trustees, agents, officers, and employees of the above-named entities from any and all claims, demands, rights, promises, damages, and liabilities arising out of or in connection with the use or distribution of said photographs, including but not limited to any claims for invasion of privacy, appropriation of likeness or defamation.

  14. Use of personal data received by in the course of the promotion is subject to the privacy policy found on the Case Management Institute, LLC Website. Winners’ names and photos may be published on the Website.

  15. Completion and submission will be deemed acceptance of these terms and conditions.

  16. Case Management Institute, LLC reserves the right at any time to cancel, modify or supersede the competition (including altering prizes) if, in our sole discretion, a competition is not capable of being conducted as specified. Case Management Institute, LLC reserves the right to substitute a prize of equal value in the event that circumstances beyond their control make this unavoidable.

  18. Choice of Law and Jurisdiction. This Agreement shall be governed by the laws of the State of Florida without regard to its conflict of laws doctrine, and applicable federal laws of the United States of America.

DISPUTES

As part of the consideration that the Website requires for viewing, using or interacting with this website, the Visitor agrees to use binding arbitration for any claim, dispute, or controversy (“CLAIM”) of any kind (whether in contract, tort, or otherwise) arising out of or relating to this purchase, this product, including solicitation issues, privacy issues, and terms of use issues.

The arbitration shall be conducted pursuant to the rules of the American Arbitration Association which are in effect on the date a dispute is submitted to the American Arbitration Association. Information about the American Arbitration Association, its rules, and its forms are available from the American Arbitration Association, 335 Madison Avenue, Floor 10, New York, New York, 10017-4605. The hearing will take place in the city or county of the Promoter.

In no case shall the viewer, visitor, member, subscriber or customer have the right to go to court or have a jury trial. Viewer, visitor, member, subscriber, or customer will not have the right to engage in pre-trial discovery except as provided in the rules; you will not have the right to participate as a representative or member of any class of claimants pertaining to any claim subject to arbitration; the arbitrator’s decision will be final and binding with limited rights of appeal.

The prevailing party shall be reimbursed by the other party for any and all costs associated with the dispute arbitration, including attorney fees, collection fees, investigation fees, and travel expenses.

JURISDICTION AND VENUE

If any matter concerning this purchase shall be brought before a court of law, pre-or post-arbitration, Viewer, visitor, member, subscriber or customer agrees to that the sole and proper jurisdiction to be the state and city declared in the contact information of the web owner unless otherwise here specified. In the event that litigation is in a federal court, the proper court shall be the closest federal court to the Promoter’s address.

APPLICABLE LAW

Viewer, visitor, member, subscriber, or customer agrees that the applicable law to be applied shall, in all cases, be that of the state of the Promoter.
